A preliminary hearing for three Minnesota basketball players accused of sexual assault will be open except when the alleged victim testifies, a judge has ruled in Madison, Wis.
Judge Robert Pekowsky said that a court reporter will read the 18-year-old woman’s testimony for reporters immediately after the hearing Thursday.
The judge has not yet ruled on a challenge by several news organizations on the constitutionality of a closed hearing.
Kevin Smith, Mitchell Lee and George Williams are charged with raping the woman at the Concourse Hotel in Madison early Jan. 24. The Gophers were staying at the hotel after defeating Wisconsin the previous night.
