Court Clears Way for Suits Against Burbank Airport

WASHINGTON — The Supreme Court today cleared the way for Burbank, Calif., residents to sue operators of a neighboring airport for noise, smoke and vibrations from flights.
The court, without comment, let stand a ruling that the Burbank airport is not shielded from continual damage suits merely because federal, rather than state or local, laws govern airport regulation.
The Burbank airport is run by a public authority representing the cities of Burbank, Glendale and Pasadena.
Last September, the California Supreme Court said homeowners near Burbank airport may sue even though they missed the normal deadline for filing a court complaint in such cases.
The suit was filed in 1982, four years after the airport was acquired by the three cities. The residents are seeking $100,000 each for mental and emotional distress and $100,000 each for property damage.
