Bradley and Rose Bird

Mayor Bradley took a courageous stand. It might have been politically expedient for him to jump on the “Bash-Bird” bandwagon. He chose, instead, to remain on the higher and more proper ground of removing the state Supreme Court from the political arena.

That Gov. George Deukmejian has hooked his campaign to a litmus test on Bird’s judicial decisions is not to his credit. What he and other candidates are really saying is that Supreme Court justices should weigh their legal judgment against a popularity index. How frightening!

I completely agree with Bradley’s concern about the independence of our courts. If Bird, or any other justice, is incompetent or in any other way not equal to the monumental task of the office, she/he should answer to the review of her/his peers. The only issue should be the justice’s capacity to follow the law. The electorate should not hold a justice accountable for bad law. That responsibility needs to be the burden of those we elect to represent us in the Legislature.
