Ploy Used to Speed Bond Issue
City Clerk Diedre D. Lingenfelter refused to sign a resolution passed by the City Council Wednesday night, so the council voted again--to sue her.
City attorneys will file a lawsuit in Riverside County Superior Court asking a judge to order Lingenfelter to sign the resolution authorizing a $15-million bond issue for public improvements in a planned West Corona development.
Lingenfelter isn’t on the outs with the councilmen, though. Her refusal to sign the measure is just a legal tactic, a way to create a dispute and get the bond issue into court.
That way, the city hopes to get a judge to validate the procedure used to create a “community facilities district” for the 1,420-acre Sierra del Oro project, explained City Manager James Wheaton.
The bonds would pay for public improvements such as water lines, sewers, streets and fire stations. Future residents of the district would pay off the bonds through a surcharge on their property taxes.
