A judge, Peter Stone, questioning the constitutionality of the National Collegiate Athletic Association’s mandatory drug-testing program, issued a temporary restraining order in San Jose prohibiting the college sports organization from barring a Stanford University diver from competition.
The decision, in favor of female diver Simone LeVant, 21, was the first challenge to the NCAA’s new policy of making all athletes submit to drug tests before they can compete in college athletics. Levant had refused to take the test.
LeVant’s attorney, Robert Van Nest, said the restraining order only affects LeVant, who has so far missed two diving meets.
