A federal judge today reversed himself and declared a mistrial in the lawsuit stemming from the 1986 Cerritos air crash disaster that killed 82 people.

U.S. District Judge David V. Kenyon rejected his own earlier suggestion of conducting a “minitrial” to allow a jury to decide whether the pilot of a private aircraft was dead before his single-engine Piper Archer collided with an Aeromexico DC-9 jetliner over Cerritos on Aug. 31 that year. Kenyon said today that it simply would be “cleaner” to start over with a new jury on Tuesday.
