3rd Man Sentenced in Balboa Park Rape

A third man convicted of raping a young woman in Balboa Park was sentenced Friday to seven years in state prison.

The sentence given to Gabriel Gutierrez, 22, an undocumented worker, was the same as those handed down Thursday against two co-defendants.

Jose de Jesus Hernandez-Leyva, 24, and Manuel Ponce Renteria, 20, also undocumented workers, received seven-year prison sentences from the same judge, Robert Stahl Jr. of the San Diego Municipal Court.

All three men were also fined $100.

The 22-year-old Santee woman was attacked Aug. 22 in some bushes near the Laurel Street bridge.

A fourth co-defendant, Michael DeLeon, 20, will be sentenced Jan. 24. DeLeon was remanded to Juvenile Court last month when the question of his age came up, but authorities have since confirmed that he was an adult when the crime was committed.

However, two other males in the case are juveniles and their cases are being handled in Juvenile Court.
