SIMI VALLEY : Developer Sues City Over Assessment

The developer of a Simi Valley shopping center has filed suit against the city, alleging that it is being overcharged for the widening of a portion of Madera Road.

The lawsuit, filed Monday in Ventura County Superior Court by Lederer Development Corp. of Encino, stems from a resolution passed last month by the City Council requiring eight property owners along Madera Road to pay for most of the road’s widening between Los Angeles Avenue and Country Club Drive.

Lederer’s share of the 1986-1987 road improvement project has been assessed at $650,000, said Garrett L. Hanken, the attorney representing Lederer.

Hanken said Lederer has already put about $200,000 into construction and paving along Madera Road and should not have to pay more. “We’ve already paid enough,” Hanken said.

Officials with the city attorney’s office could not be reached for comment.

A hearing on the matter is scheduled for Aug. 10 in Superior Court, Hanken said.
