Fullerton Father Will Not Be Charged

The father of a Fullerton High School football player arrested after an altercation with Buena Park Coach Martin Luczaj after a game Nov. 9 will not be charged with assault and battery, an official with the North Orange County district attorney’s office said Thursday.

After viewing a videotape of the incident and reviewing witnesses’ statements, Deputy Dist. Atty. Diana Gomez said she determined there wasn’t sufficient evidence to prove that Joey Hernandez Sr.’s actions were unprovoked.

Gomez said the tape shows Luczaj speaking to Joey Hernandez Jr., a Fullerton fullback and linebacker who had injured his knee in the first half of the game, immediately before the elder Hernandez shoved Luczaj, who was uninjured. Witnesses’ accounts of what was said were in conflict, Gomez said.
