A 35-year-old resident here was listed in fair condition Tuesday after he lost control of his Porsche on Warner Avenue, hit a palm tree, then a brick wall and a light pole, police said.

Raymond Nieto was speeding westbound on Warner Avenue with his son and a family friend about 3:40 p.m. Monday when he ran off the road at Edgewater Lane, Lt. Jeff Cope said. None of the three were wearing seat belts, and all were ejected from the car.

Nieto was flown to Long Beach Memorial Hospital, where he was first listed in critical condition but has improved, hospital officials said.

His son, Raymond Nieto Jr., 13, was released from Humana Hospital-Huntington Beach after treatment for a broken elbow, Cope said. Jason Smith, 13, of Huntington Beach, who suffered a broken leg and bruises, was treated at the same medical center.

No one was cited, and an investigation is ongoing, Cope said.
