Hearing Is March 19 for Big ‘Cap Appeal

A hearing to consider an appeal of The Wicked North’s disqualification in last Saturday’s $1-million Santa Anita Handicap is scheduled for March 19 at Santa Anita.

After The Wicked North was moved from first to fourth by the stewards for alleged interference early in the stretch, owner Philip Hersh and trainer David Bernstein appealed.

Steven Schwartz was named the hearing officer by the California Horse Racing Board. Schwartz also served in that capacity when the connections of Tight Spot appealed their colt’s disqualification in the 1990 Del Mar Derby. That decision was overturned.

After Schwartz hears the matter, he will recommend a decision to the CHRB at its next general meeting. The CHRB then makes its decision in executive session.

Stuka was given the victory after the disqualification, but the winner’s share of the purse ($550,000) is being held in escrow.
