GARDEN GROVE : City to Stay Clear of Day-Care Regulations

People operating home-based child-care businesses would no longer need use permits under an ordinance the City Council tentatively approved this week.

In addition, a public hearing, which in the past has given neighbors an opportunity to raise objections, will no longer be required before such an enterprise is allowed to open.

City officials said Tuesday the regulations were useless because, under state law, the city has no authority over home-based child-care businesses. Such enterprises are licensed by the state.

The council will consider the ordinance for final approval in May. If approved, it would take effect in June.

After that, a license from the Orange County Department of Social Services would be the only requirement to operate a baby-sitting or after-school-care service from home, officials said. State law, however, requires that the operator adhere to strict design and safety standards for activity and play areas.

The ordinance applies to large family day-care homes, which provide baby-sitting and after-school care for as many as 12 children from private homes. The city still would regulate centers in commercial areas that serve more than 12 children.
