A judge Thursday ordered a 13-year-old boy charged with involuntary manslaughter in the shooting death of his 14-year-old cousin to remain in custody while awaiting an Aug. 8 trial.

The boy, whose name is being withheld because of his age, will return to court July 28 for a pretrial hearing, Deputy Dist. Atty. Deborah Lloyd said.

She declined further comment about the confidential hearing before Presiding Juvenile Court Judge Frank F. Fasel.

The boy is accused of shooting and killing his cousin, James Valentine, while showing off a semiautomatic handgun as they played with other teen-agers Monday in a boarded-up duplex in Garden Grove.

Lloyd said Thursday that charges have not been brought against the owner of the handgun, whom she declined to identify. Garden Grove Police Lt. John Woods said the investigation in the case is ongoing.

Garden Grove police initially sought murder charges against the Santa Ana boy, but prosecutors decided Wednesday to seek the lesser charge of involuntary manslaughter because they said the killing was not intentional. Prosecutors also cited the boy’s age, lack of a previous criminal record and the circumstances surrounding the shooting.

Meanwhile, a memorial service for James Valentine was set for 7 p.m. Monday at King of Kings Lutheran Church in Garden Grove. Family friends have also set up a fund for donations at Sanwa Bank in Irvine to help pay for funeral costs. Donations can be sent in care of the James M. Valentine III Memorial Fund, Sanwa Bank, 18022 Culver Drive, Irvine, CA 92715.
