Building Defect Settlement Against Former Glendale Federal Unit OKd

An Orange County judge Tuesday approved a $2-million settlement in a construction defects lawsuit filed against a former division of Glendale Federal Bank.

Earlier this year, Superior Court Judge William F. McDonald ruled that Glendale Federal Bank was legally responsible for work performed by its now-defunct Glenfed Development Corp. in Loma Vista. That development is a community of 196 single-family homes in San Juan Capistrano, said David Epstein, an Irvine lawyer who brought the case on behalf of the plaintiffs, the Loma Vista Owners Assn.

The homeowners sued because Glenfed did not maintain the common areas of Loma Vista.

“This is for streets, curbs, draining and other . . . areas that had various problems--the streets were cracking and some trees were never planted,” Epstein said.

“This is a somewhat unusual construction defect case in that it has nothing to do with leaking windows or missing fire walls.”
