Members of the Clean Water Now Coalition, a Laguna Beach group formed to clean up the bacteria pollution in Aliso Creek, said Monday that they are “inching closer to a lawsuit” against the city of Laguna Niguel for violation of the Federal Clean Water Act. Member Roger Von Butow said his group has collected most of the background information needed to sue the city.

City Public Works Director Ken Montgomery said the city’s tests last week showed some improvements in water quality that could be because of information fliers sent out to residents in the Kite Hill area. Water flowing from that area into the creek was found to have high bacteria content during tests performed by the county and the city.

“A lawsuit is not going to change the way we approach the problem,” Montgomery said. “The diversion system is the only solution at hand now and that’s what we are going to achieve.”
