A driver involved in a fatal car crash Aug. 26 tested below the legal blood-alcohol level of 0.08%, authorities said Wednesday.

Passenger Lisa Ross was fatally injured when the Isuzu Trooper she was riding in collided with a truck at Portola Parkway and Lake Forest Drive, an Orange County Sheriff’s spokesman said.

The Trooper driver, who remained in critical condition Wednesday at Mission Hospital Regional Medical Center in Mission Viejo, had been under “technical arrest” so she could be tested for substance abuse, sheriff’s spokesman Jim Amormino said, “but alcohol was definitely not a factor.”

The accident happened about 2:30 a.m. during a power failure that caused street lights and traffic signals to go out, officials said. Another passenger in the Trooper said neither he nor the driver saw the signal or the truck.

The driver of the truck was treated at the scene and released.
