Peterson’s Preliminary Hearing to Remain Open

Scott Peterson’s preliminary hearing on double-murder charges will remain open to the public, the 5th District Court of Appeal has ruled.

Peterson’s attorneys had appealed a Modesto judge’s decision to keep open the Sept. 9 preliminary hearing, when prosecutors will lay out their case in detail for the first time.

Peterson’s defense attorney, Mark Geragos, had argued that an open hearing would taint the jury pool.

Peterson, 30, has pleaded not guilty to charges that he killed his 27-year-old wife, Laci, and their son. Prosecutors are seeking the death penalty.
