Challenge to Water Allocation Is Rejected

SAN DIEGO

A state appeals court rejected San Diego’s challenge to a water-allocation formula that gives Los Angeles priority over San Diego during droughts.

The 1st District Court of Appeal in San Francisco upheld a lower court ruling backing the Metropolitan Water District of Southern California, the region’s water wholesaler.

Under its charter, MWD says that, during drought shortages, it is to allocate water to member agencies on the basis of their infrastructure payments to MWD.

That formula favors Los Angeles, which joined MWD long before San Diego.

San Diego sued to overturn the formula, lost in Superior Court and then appealed.
