Death penalty won’t be sought for ex-firefighter

Prosecutors said Thursday that they would not seek the death penalty against a former Los Angeles city fire captain who is accused of killing a woman in his Eagle Rock home and dumping her body.

David J. Del Toro, 50, pleaded not guilty Thursday to the August murder of Jennifer Flores. He is being held without bail.

Jane Robison, a district attorney’s office spokeswoman, said a committee of prosecutors makes the decision for or against capital punishment. Criteria include previous felonies, mental impairment and the age of the accused.

Prosecutors said Del Toro broke Flores’ nose, jaw and ribs before killing her and dumping her on a residential street.
