Ex-CHP Officer’s Murder Conviction Upheld

A federal appeals court Monday upheld the conviction of former California Highway Patrol Officer George Gwaltney for the 1982 kidnaping, rape and murder of a woman near Barstow.

The 9th U.S. Circuit Court of Appeals, on a 2-1 vote, also ruled that Los Angeles federal Judge Pamela Ann Rymer had not exceeded her authority when she ordered that Gwaltney, 44, had to serve at least one-third of his 90-year sentence before being eligible for parole.

Gwaltney had argued that expert testimony about semen tests linking him to the death of Robin Bishop, 23, should not have been admitted, but the judges disagreed.
