A San Francisco Police Department examination designed to increase the number of women and minority officers eligible for promotion to sergeant and assistant inspector was invalidated 2 to 1 by a U.S. 9th Circuit Court of Appeals panel on the grounds that it violated the civil rights of white men. The appeals court said the original test was unfair to women and minorities, but ruled that the city “inappropriately attempted to take shortcuts” to correct the problem. The city and the Civil Service Commission now must go back to federal district court with a new plan that does not discriminate against anyone, the judges said. City Atty. Louise Renne said the city may seek a rehearing or appeal to the U.S. Supreme Court.
