Unborn fetuses are not commuters, a Santa Ana judge ruled, throwing out a pregnant woman’s claims that she was eligible to travel in freeway car-pool lanes because of her “passenger.” Municipal Judge Pro-Tem Robert Harris found Diane Correll--who said she was seven months pregnant when she was ticketed for driving alone in the commuter lanes on the Newport Freeway--guilty of the traffic infraction. But he did not fine her, saying there was sufficient confusion surrounding the commuter laws. Correll had gone to court armed with newspaper clippings concerning the case of Sue Ann Yasger, 29, of Fullerton, who beat a similar ticket last January with a note from her doctor. But court officials said that case was not a true precedent.
