The jury in the retrial of accused police killer Sagon Penn, sequestered for a second day, had reached no verdict by the time court closed Tuesday.

Any verdict reached by the panel during the evening would not be announced until early today. The jurors have been deliberating for 22 days.

Penn, 25, faces five felony counts in the shooting death more than two years ago of San Diego Police Agent Thomas Riggs and the wounding of Agent Donovan Jacobs and civilian ride-along Sarah Pina Ruiz.

The defense claims that Penn, who is black, was firing to defend himself from a racially motivated attack.
