Capistrano Beach : Couple Seeks $750,000 Because House is Sliding

A Capistrano Beach couple has sued Orange County, two cities and several government agencies for $750,000 because the family home is sliding down a cliff.

In a lawsuit filed Thursday in Orange County Superior Court, Eugene and Delphine Slaby said they moved into the home on Camino Capistrano in November, 1977. Nine years later, they learned that the rear of the residence had started to “subside and crack, and settle down the face of the coastal bluff,” court papers said.

The suit alleged that an increase in the water table and hydrologic pressure under the Slaby property produced the slippage, which then caused parts of the land “to become unduly unstable and to subside or sever” from the rest of the parcel.

In addition to the county, defendants include the cities of San Juan Capistrano and San Clemente, the county Board of Supervisors, San Juan’s Planning Commission and eight other agencies.
