Two Fresno welfare workers with lung disease that made them hypersensitive to tobacco smoke have been awarded more than $70,000 by a state commission for the county’s failure to protect them from smoke. Even though Fresno County was in the process of developing an overall policy to limit smoking in county buildings, the two workers should have been given immediate protection, the Fair Employment and Housing Commission said in a unanimous decision. Concluding that the county had violated state laws banning discrimination against the physically handicapped, the commission ordered damages of $40,000 to Danyse Brooks of Clovis and $30,000 to Camille Capo of Fresno for pain and emotional distress.
