Yacht Club Should Give Up the Cup, Then Win It Back
It seems to me that Judge Carmen Ciparik missed a fine opportunity to apply the doctrine of “judicial restraint” in the America’s Cup case.
Since even a judge will admit that a lawsuit is not the best way to decide a boat race, and even a lawyer would find that the behavior of both the Conner and Fay camps violated the spirit of the original gift, it might have been wiser to send this problem back to where it originated by appointing a referee such as the New York Yacht Club to supervise the competition.
