Ruby Mae Brown, convicted of animal cruelty to dogs in the kennel she once operated, was sentenced Thursday to 89 days in jail for her latest misdemeanor conviction.

Brown, 61, did not appear for sentencing before San Diego Municipal Court Judge Robert McDonald, who ordered her to report to his courtroom on Monday to begin her sentence.

He also fined her $2,500.

A previous sentencing agreement would have allowed Brown to be on three years’ probation during which she could not possess more than six animals and not house animals for a fee.

But her attorney, Hodge Crabtree, said Thursday that Brown was refusing an additional requirement that she not own or possess a firearm during the next three years.

“I don’t want to put her in jail. She’s forcing me to,” the judge replied.

Earlier this year, Brown announced to reporters that “I will kill” if animal control officers were successful in revoking her kennel license at her Kelly’s Pet Hotel on Morena Boulevard.

Brown was jailed repeatedly after refusing to turn over an assault weapon and later turned it over to a judge.
