Two anti-abortion demonstrators convicted of failing to disperse and of trespassing during “Operation Rescue” protests were sentenced Friday to 45-day jail terms.

A third co-defendant was ordered to perform 25 days of public work.

San Diego Municipal Judge John Thompson gave the defendants three sentencing options: a 45-day jail term, public service works or probation plus a fine.

No jail time or fine was imposed against Dan Eikenberry, 31, of Escondido, who was convicted Wednesday of four misdemeanor charges of failing to disperse and of trespassing at two protests held at San Diego medical facilities that provide abortions.

Eikenberry was the only one to choose the public service works.

The other two demonstrators, Ron Brock, 51, of Oceanside, and James Meyer, 24, of Clairemont, were sentenced to 45-day jail terms.

The judge at first allowed Brock and Meyer to remain free on their own recognizance while appealing their convictions, but ordered that they must refrain from participating in future “Operation Rescue” protests.

Brock agreed to the restriction and was freed, but Meyer said he could not and was jailed immediately in lieu of $5,000 bail.

The demonstrations occurred April 8 and 29.

The trio’s attorney, Gregory Anthony, himself has a hearing set for Tuesday at which Thompson may impose a fine for contempt of court.

The jury reached its verdicts last Tuesday, but Anthony could not be located then, and the jury had to return to court Wednesday when the attorney could be found.

Thompson said he wanted a hearing so Anthony can explain what happened.
