A jury Friday convicted a Southeast San Diego man of first-degree murder in the death of a fetus after the man wounded an expectant mother in a robbery attempt.

After two days of deliberations, the Superior Court jury also convicted Robert Anthony Davis, 21, of robbery and assault with a deadly weapon in the shooting of Maria Trinidad Flores, 21, who was shot in the chest as she was leaving a check-cashing business on Imperial Avenue.

The jury found Davis not guilty of attempting to murder the woman.

The district attorney’s office had decided against seeking the death penalty, and Davis will probably be sentenced to life without the possibility of parole. Sentencing was scheduled for Jan. 7.

The fetus was about 24 weeks old. Testimony during the weeklong trial revolved around whether the fetus could have lived had its mother not been shot.

Davis remains in County Jail without bail.
