Glendale : Drug Test Ruling Appealed

The American Civil Liberties Union has appealed a judge’s ruling that the city must scale back its sweeping policy of requiring all job applicants and all candidates for promotion to undergo mandatory drug testing.

In its filing with the state Court of Appeal, the ACLU said Los Angeles Superior Court Judge Ernest Williams’ ruling does not go far enough to limit the amount of testing the city could conduct. The ruling, the ACLU said, is “too permissive” and allows Glendale government to “overstep its rightful authority.”

Although Williams found that drug testing violated the constitutional right to privacy, he ruled that it was appropriate for prospective law enforcement officers, for people who would be entrusted with public safety, or for people who would have access to large amounts of money.
