SAN DIEGO : Woman Files Suit Against Ex-Padre
A San Diego woman who said she was raped by Kevin Mitchell but refused to have him prosecuted on criminal charges has filed a lawsuit seeking monetary damages from the baseball star.
Linda Chavers, 25, claims in the lawsuit filed Sept. 24 that she was raped by Mitchell on Nov. 29, 1991, in his Chula Vista home. The suit seeks unspecified damages.
Chavers’ attorney, Patricia Robinson, said Chavers was pregnant with Mitchell’s child at the time. She did not cooperate with prosecutors because she did not want to see Mitchell sent to jail, Robinson said.
Chavers also has filed a paternity suit against Mitchell, seeking child support for her son, who was born July 25. A hearing on that suit is scheduled for Monday.
Mitchell could not be reached for comment.
Mitchell, a former San Diego Padre fielder, was traded from the San Francisco Giants to the Seattle Mariners in December, a trade he attributed in part to the rape allegation by Chavers.
