SAN DIEGO : Student in Custody Won’t Be Charged

Prosecutors decided Tuesday to not file charges against a community college student who was arrested last week on suspicion of killing two Laotians 10 months ago.

Mon Smann, 21, of East San Diego was expected to be released from custody Tuesday night after being held in jail for almost a week.

Police arrested Smann last Wednesday on suspicion of shooting Chang Lee, 16, and Sisouphanh Khamphila, 18, several times in the back of the head.

Their bodies were found Feb. 2 on the front lawn of Samuel E. Morse High School in Southeast San Diego. Both victims lived in East San Diego but neither attended the school.

Deputy Dist. Atty. James Fitzpatrick said Tuesday that after evaluating all of the police evidence, “there remains insufficient evidence from which to proceed.”
