Linebacker Jamir Miller of the Cleveland Browns has been dismissed as a defendant in a civil lawsuit filed by a woman who claims she was raped during a promotional boat ride on the Cuyahoga River.

F. Benjamin Riek III, attorney for the alleged victim, said the amended complaint filed Monday does not include Miller because “the facts have indicated he did not assault my client.”

The lawsuit alleges the attack took place early on Aug. 1, 1999, while the woman was working for a boat dealer conducting a “getaway outing” for new and potential customers.

While Miller was on the boat sometime during the trip, Riek said it has not been determined whether he was on board when the 26-year-old Cleveland woman said she was raped.

Oakland Raider rookie kicker Sebastian Janikowski was admitted to an Oakland-area hospital Monday with an infection in his left foot, Coach Jon Gruden said.

Janikowski has cellulitis, a bacterial virus, and will be on antibiotics for a few days, Gruden said. Janikowski is listed as questionable for Monday’s game at Denver, but the team said he is expected to be able to play.

Two weeks after losing his starting job, safety Kevin Williams was waived by the New York Jets.

Williams, 25, made a remarkable recovery from a life-threatening throat infection that forced him to sit out most of the 1999 season, but he was benched as the starting free safety two weeks ago with the Jets showing serious vulnerability in the defensive backfield.
