Ex-Officer Charged in Baby’s Death

A former police officer has been charged in the death of a baby delivered after his mother, brother and aunt were killed in a drunken driving accident.

An indictment announced Tuesday charged the driver, Joseph Gray, with second-degree manslaughter in the baby’s death.

Gray already has pleaded not guilty to charges of manslaughter and other offenses in the Aug. 4 deaths of the baby’s mother, Maria Herrera, 24; her 4-year-old son, Andy; and her 16-year-old sister, Dilcia Pena.

Herrera was eight months’ pregnant at the time of the accident. Her baby was delivered by Caesarean section.

Brooklyn Dist. Atty. Charles Hynes said the child had a heartbeat for 12 hours after the delivery.

Gray, 41, a 15-year veteran, resigned last week. His is accused of going on a drinking binge before mowing down the family on his way to work.
