The Southern California Rapid Transit District said it violated the rights of two bus drivers involved in recent accidents when it publicly released test results that showed the drivers had drugs in their blood. The RTD general counsel’s office determined that releasing results of drug tests violated employee rights to confidentiality regarding medical matters, spokesman Marc Littman said. As a result, the RTD will no longer publicly release such information, he said. Vivian Harris and Clarence Brown Jr., RTD drivers involved in separate accidents last May, were tested and found to have drugs in their blood. The district subsequently released findings of the tests to the media. “We did violate their rights, although we didn’t know it at the time,” Littman said. “Whether they can take legal action, that remains to be seen.”
