Azusa : Ex-Councilman Sues Mayor
Former Councilman Robert Fry has filed a lawsuit against Mayor Eugene Moses seeking $500,000 in damages for malicious prosecution.
The suit, filed in Pomona Superior Court, says that Fry incurred “mental and emotional distress” and had his reputation harmed by a lawsuit that Moses filed against him five years ago. In the 1982 suit, Moses accused Fry and others of circulating rumors that Moses had beaten a woman and molested her daughter. The suit ended when an arbitrator ruled that Moses had failed to state a cause of action against Fry. Moses said the case was lost because his attorney failed to appear at the arbitration hearing.
In the new suit, Fry charged that Moses sued him “intending that this would be broadcast and attract newspaper attention and provide political capital for . . . Moses while doing intentional harm to Fry and to his family.”
