USFL Seeks to Reverse Suit Ruling
The United States Football League was back in court Monday, trying to get a federal appeals judge in New York to reverse a jury decision of almost 11 months ago in the USFL’s antitrust suit against the National Football League.
A jury found the NFL guilty on only one count in a multi-count case last July 29 but awarded the USFL only $1 in damages, which was then tripled, as is the custom in antitrust cases.
USFL attorney Harvey Myerson told the Second U.S. Court of Appeals that trial judge Peter K. Leisure erred in his 152 pages of instructions to the jury. Myerson labled the verdict “incongruous,” and blamed the instructions for the jury’s finding the NFL not guilty on so many of the serious charges.
