Two people injured in a roller coaster collision last summer at the Orange County Fair have filed a lawsuit seeking compensation for medical and other expenses and $1 million in punitive damages.

The lawsuit, filed in Orange County Superior Court on behalf of Christopher W. Pitts and Melinda S. Greenleaf, accuses B&B; Amusements, owner and operator of the Cyclone roller coaster, and the Orange County Fair of negligence.

As result of the July 12 collision, the two suffered permanent physical injuries, according to the suit.

The two were among eight people injured when a two-car train full of passengers crashed into an empty train, which in turn hit a train that was being loaded with passengers, officials said at the time.

A state Department of Industrial Relations report later concluded that a bell that normally rang to warn the brakeman of a train’s approach was not functioning, but said the ultimate cause of the collision was operator error.

The parties involved in the suit could not be reached for comment Monday evening.
