NEWBURY PARK : Sierra Club Lawyers Hope to Halt Project

Sierra Club lawyers are trying to block construction of a Newbury Park housing development until they can appeal a judge’s ruling allowing the Dos Vientos project, according to court records.

Returning to court Monday, the environmental group is requesting a temporary stay on a judge’s order that cleared the way for a 220-home phase of the project to proceed, court records show.

Attorneys have not yet filed an appeal of the May 16 ruling by Superior Court Judge Barbara A. Lane, who concluded that the city of Thousand Oaks had acted legally in approving that phase of the project. The development is planned for land adjacent to National Park Service property and Broome Ranch.

The Sierra Club filed the suit last fall, saying that the city had put the interests of developers above those of the environment by approving a development that will bring excessive noise and traffic to nearby areas.

But city officials said the city is bound by development agreements signed in 1990, allowing Operating Engineers and Courtly Homes to build on the land. The city will receive about 1,200 acres of open space and $12.6 million in developers’ fees in exchange.
