No rape charges filed against cop

The Los Angeles County district attorney’s office declined to file charges against a city police officer who was accused of the on-duty rape of a visiting Florida woman in 2006, officials said Monday.

After a review that lasted more than a year and a half, the district attorney’s office concluded that “at least one sexual act occurred” between Officer Donvey Lindsey and the woman, who officers accused of being a prostitute, according to a report by the office dated Sept. 30.

The woman had the “appearance and conduct . . . consistent with prostitution,” making it difficult for prosecutors to prove that the sex was not consensual, the report found.

She also had an arrest record for prostitution in her home state, where she had accused officers of misconduct, according to the report.

The woman told investigators that Lindsey followed her to her motel room and had a hand on his gun as he ordered her to perform sexual acts on him and raped her. She was taken to a hospital, where she provided a trash bag in which Lindsey’s semen was found, according to the report.

Lindsey is no longer a police officer for Inglewood, said department spokesman Lt. Mike McBride.

The FBI, the U.S. attorney’s office and the Inglewood Police Department were also involved in the investigation.
