Lake Forest councilman pleads no contest to DUI
A 57-year-old Lake Forest City Council member has pleaded no contest to driving under the influence of alcohol after he was spotted driving on the wrong side of the road, authorities said.
Peter Alan Herzog pleaded to a misdemeanor charge of driving under the influence after he was suspected of driving with a blood alcohol content of more than twice the legal limit.
On Nov. 17 around 8:15 p.m., Herzog made a left turn from Portola Parkway onto Lake Forest Drive onto the wrong side of the road, according to the Orange County District Attorney’s Office.
Herzog drove over the center median to get back onto the westbound lanes of Lake Forest Drive, then made a wide left turn onto Regency Lane, hitting the right side of the curb, prosecutors said.
The councilman then crossed into the opposing lane of traffic and swerved back and forth until he arrived home, authorities said.
Motorists reported the incident and Orange County Sheriff’s Department arrested Herzog at his home.
Prosecutors say he displayed signs of intoxication including bloodshot and watery eyes, slurred speech, a strong odor of alcohol and unsteady balance.
Herzog was sentenced to three years of informal probation, fines, and required to participate in a 3-month first-offender alcohol program.
