Pacific Palisades : Accord in Footpath Dispute

Residents of Latimer Road in the Rustic Canyon area have reached a settlement in their five-year legal fight to retain use of a footpath that a neighbor had sought for his family’s exclusive use.

The settlement, which pitted 180 homeowners against the family of Steven Tisch, will allow the homeowners the right to cross Rustic Creek and walk over a path to Sunset Boulevard.

The Tisches, who own the property, obtained a court injunction in 1980 barring neighboring homeowners from using the footpath and kept them from rebuilding a bridge that connected it with Sunset Boulevard. The bridge had been washed away by heavy rains.

Residents claimed that by eliminating access to the footpath, a safety hazard was created since pedestrians would be forced to trek through the narrow canyons and would have difficulty escaping their homes in case of fire. The Los Angeles Fire Department supported their claim.

As part of the settlement, the homeowners will not be reimbursed for any court costs in the case, about $25,000.
