Orange County prosecutors on Wednesday filed vehicular manslaughter charges against a 43-year-old motorist who allegedly caused the fiery accident last month that burned to death a mother, her son and her stepson.

The only other survivor, the boys’ father, left the hospital two weeks ago.

Authorities say that Timothy Edward Albright rear-ended the family’s 1988 Mazda sedan while trying to make a lane change, causing the vehicle to explode. Albright was allegedly traveling more than 60 mph, which was 20 mph over the posted speed limit, officials said.

Albright, a Santa Ana resident who has no previous criminal convictions, faces up to three years in jail, according to Tori Richards of the district attorney’s office.

Upon impact, the Mazda burst into flames and was propelled into oncoming traffic. Killed were Jerrod Damon Perry Howard, 4 months, and David Alexander Loera Howard, 4. Angela Howard, 24, the mother of the younger boy, died two weeks later.

Her husband, 32-year-old Perry Howard of Buena Park, was driving the Mazda. He suffered burns over 35% of his body.
