High Court to Review Validity of Coastal Panel
- Share via
The California Supreme Court decided unanimously Wednesday to review the constitutionality of the California Coastal Commission.
Meeting in closed session, the court agreed to review a lower court decision that said the commission was unconstitutional in the way that members were appointed and removed.
The state high court said it will look at whether the ruling, if correct, is retroactive and affects previous decisions by the commission.
In February, the Legislature responded to the appellate court ruling by passing a bill making it impossible for legislators to remove their appointees at will. The state high court said it will determine whether that law still leaves the commission vulnerable to constitutional challenges.
